Serenity Apartments Facilities Management


More and more people these days are purchasing properties on a residential complex or with communal facilities. The most obvious advantage of such an investment, apart from the cost saving, is the fact that owners can enjoy the pool and other facilities without the headache of the upkeep.

But in reality this is not always the case. Too often there is no proper management in place for the facilities (the pool is out of operation or the garden became a jumble of weeds). Residents soon discover that complex falls into a state of disrepair with deferred maintenance, which not only means that they don't get the enjoyment but it also leads to decreased property values.

In order to pre-empt these problems, it is important to be in close consultation with maintenance company, which will advise on the necessary arrangements to be detailed in the sales contract so that a smooth facilities management service can be offered from the initial stage of handover.

Following are some questions that owners of property on a complex should ask:

•  What are the terms in the sales contract regarding facilities management? The terms should be clearly stated in the contract otherwise problems are inevitable as some may pay and others not. It is vital that a comprehensive contract is put in place to reduce the threat of dispute.

•  Who will be responsible for the maintenance, the developer or a specialized company? Often the developer agrees to take on the management for a set time in order to maintain the complex as a show-piece for prospective purchases. After that it is often left to the owners. It is better to have a specialized company that will always be responsible for maintenance.

•  What is the annual fee? Annual management fees depend on the surface covering the public areas, the type and quantity of public facilities, etc. Owners should also expect this fee to increase in parallel with inflation.

•  Is there an Owner's Committee already set up? There should be one Owner's Representative, which can act on behalf of all owners and to whom all complaints can be lodged for problem resolution.

•  What are the CC&R (Conditions, Covenants and Restrictions)? These stipulate what is not allowed on the complex, for example walking with pets may be forbidden.

•  Who is responsible for budgeting and accounting? The owner can demand regular reports so he can see exactly where the finances are going.

•  What is the legal situation? Unless there is a contract signed by all the owners, one cannot expect legal disputes to be resolved through the constitution since there is only one law about communal properties, which is related only to the common stairways.
